What is a spinal surgery claim?

Spinal surgery is intended to reduce or completely eliminate the amount of back pain you suffer with. 

There are a number of different types of spinal surgery, including spinal fusion surgery, discectomy, disc replacement surgery and laminectomy. The majority of these surgeries go ahead without any problems. But things don't always go to plan.

Why should I make a spinal surgery claim?

Is there a time limit for spinal surgery claims?

In most cases of spinal surgery claims, you’ll face a time limit of three years. You should make sure you start the process as soon as possible to get your claim submitted before the deadline.

There are some exceptions to the medical negligence claims time limit, though. Children can make a claim at any point until their 18th birthday. After that, the three-year time limit will begin, meaning they have up to their 21st birthday to make a claim.

If you’re claiming on behalf of someone who lacks the mental capacity to claim for themselves, you won’t face a time limit unless they regain capacity. If they are not expected to regain capacity, you won’t face a time limit.
